Sungate will award one (1) grand prize, (1) second prize, (1) third prize, and (42) bonus winners in that drawing. All prize periods end on December 31, 2011. Winners will be determined from a random drawing of all entries received during the applicable prize period. The odds of winning any prize are determined by the number of entries received prior to the time of prize drawing, and are estimated at 1:20,000. Sungate reserves the right at its sole discretion to suspend, modify or terminate this promotion without notice at any time. Participation may be limited. Void where prohibited by law, rule, or regulation. You do not have to submit to a sales presentation to participate in this promotion. Official Sweepstakes Rules: 1. You may enter this promotion by (a) completing the preprinted card entry and mailing to Sungate at their address on return envelope; (b) completing the online sweepstakes registration form; or (c) you may print your name and your complete address on a 3" x 5" card, write the words "Sungate Grand Prize Giveaway" at the top, identify the product of interest and mail the card to Sungate at their address. Entries must be received by January 15, 2012 to qualify for the prize period drawing. No more than one entry per household is allowed. Sungate is not responsible for any illegible, misplaced, damaged, incomplete, or late entries. Entrants selected must comply with all the terms and conditions of these official rules and winning is contingent upon fulfilling all requirements. 2. The Grand Prize (1) winner may choose (i) 6-Panel Solar PV System (excluding any required electrical upgrades), (ii) Solar Hot Water System, (iii) Texture Coating (limit 30 squares) on all exterior painted walls of home, including soffit and fascia or (iv) vinyl replacement windows for their home (up to a maximum of 12 windows. All windows combined cannot exceed a total of 800 united inches) excluding basement and garage windows; approximate (ARV $15,000.00). The Second Prize (1) winner may choose (i) replacement windows (limit six double hung or sliding windows. Maximum size up to 400 united inches.) (ARV $7,500.00) or (ii) tankless hot water system. Third Prize winner (1) may choose (i) one whole house water softening system and Bonus Winners (42) will win one replacement double hung or sliding window (maximum size up to 96 united inches.); (ARV $1,250.00). ALL FEDERAL STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE ARE THE FULL RESPONSIBILITY OF THE WINNER. 3. All winners will be notified via phone and/or certified mail; return receipt requested. Acceptance or use of a prize constitutes permission for Sungate and its affiliates to use recipient's name and likeness for advertising and promotional purposes without compensation, unless otherwise prohibited by law. Sungate reserves the right to substitute any prize for another of similar value. Payment of any and all federal, state, and local taxes and/or other fees that may apply to prizes are the sole responsibility of the winner. A list of winners may be obtained by sending a self-addressed, stamped envelope to Sungate within 90 days following the end of any prize period and including a request for the winners' names. 4. Homeowner will allow photos to be taken and/or video testimonials to be produced (at Sungate's discretion). This agreement includes the homeowners' fully authorized release for these photos and/or videos allowing Sungate to post these media-based testaments online. Homeowner also grants Sungate the right to use and reproduce this media including your likeness, images of your property and your testimonial comments and/or videos on our websites, blogs and/or newsletters as well as other print and online media resources. Sungate will retain unlimited usage rights of this content for educational, statistical and/or promotional purposes. 5. Drawings: On or around February 16, 2012, Sungate will conduct a random drawing to award all prizes from all of the entries received. Failure to acknowledge a prize award within 10 days of certified mailing or otherwise comply with these terms and conditions may result in the prize being withdrawn and awarded to an alterative individual. 6. This promotion is open to legal residents,18 years and older, who own the home where the product is to be installed. Employees, officers, and directors of Sungate, its affiliates, subsidiaries, co-branded partners, consultants, contractors, advertising, public relations, promotion, fulfillment and marketing agencies, their immediate families (and those living in their household) are not eligible to participate in the promotion. By participating in the promotion, participants agree to release, discharge, and hold harmless Sungate, their affiliates, co-branded partners, subsidiaries, retailers, agencies and their respective officers, directors, employees, and agents from any damages which may arise out of participation in the promotion in any way or out of the acceptance, use, misuse, or possession of a prize. Acceptance of a prize may require entering into an affidavit of eligibility to participate in this promotion, as well as standard contract or purchase order for the goods and services to be provided, as required by state law. This promotion is conducted in English (which will be given its everyday ordinary meaning).
